General terms and conditions for private customers

1 Scope and subject matter of the contract

1.1 Christiane Strobel, address available at http://christianestrobel.com/impressum (“Seller”) , offers the purchase of various products, such as sustainable clothing (“Products”), via her website http://christianestrobel.com (“Website”).

1.2 These General Terms and Conditions for Private Customers (“GTC”) govern the contractual relationship between the customer who purchases the product (“Customer”) and the seller (together “Parties”), insofar as the Customer is a private customer.

1.3 For the purposes of these Terms and Conditions, private customers are persons who are consumers, i.e., any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity and who have their residence and delivery address in the Federal Republic of Germany.

1.4 Business customers are required to place orders via the order pages accessible through the business customer login at http://christianestrobel.com . Separate terms and conditions apply to business customers.

2. Conclusion of the contract

2.1 The presentation of the products offered on the website does not constitute a binding offer to conclude a purchase agreement, but rather an invitation to the customer to submit an offer. The customer submits a binding offer to purchase the selected products as soon as they have provided all the required information during the ordering process, accepted these Terms and Conditions, and clicked the "Pay Now" button ("Offer"). Until clicking the "Pay Now" button, the customer can cancel or change their order at any time by clicking the "Shopping Cart" button next to the item they wish to modify.

2.2 Immediately after receiving the order, the seller will send an order confirmation email to the customer's email address provided during the ordering process. This order confirmation email does not yet constitute acceptance of the order by the seller. The order confirmation email contains the essential details of the customer's order. These Terms and Conditions are included with the products and are also provided to the customer upon delivery.

2.3 The purchase agreement only comes into effect when the seller has shipped or handed over the ordered product to the customer within 10 working days of receipt of the offer, or has expressly accepted the offer by sending an order confirmation or an invoice (“conclusion of contract”).

2.4 In the case of advance payment, the contract is concluded upon provision of the bank and payment details.

3. Prices and Payment Terms

3.1 Upon conclusion of the contract, the customer undertakes to pay the purchase price agreed at the time of conclusion of the contract with regard to the products acquired by the customer plus any shipping costs agreed at the time of conclusion of the contract ("purchase price").

3.2 Unless otherwise stated, all prices are quoted gross, including statutory VAT, plus any agreed delivery and shipping costs. The purchase price will be clearly communicated to the buyer during the ordering process.

3.3 The purchase price is due upon conclusion of the contract.

3.4 Payment is made using the payment method selected by the customer during the order process. If the seller uses third-party providers for payment processing, such as Klarna or PayPal, their terms and conditions apply.

3.5 The seller reserves the right to remove or add individual payment methods. The available payment methods will be displayed to the customer before the conclusion of the contract. In the event of a chargeback, the customer is obligated to reimburse the seller for the actual costs incurred as a result of the chargeback.

4. Delivery; Retention of title

4.1 The ordered products will be delivered by the shipping provider displayed during the ordering process and, if applicable, selected by the customer. The currently available delivery options can be viewed on the website.

4.2 Delivery will be made to the delivery address specified by the customer, within Germany.

4.3 The seller is entitled to make partial deliveries, provided this is reasonable for the customer. In the event of a partial delivery, the customer only bears the shipping costs incurred for the first partial delivery. The products remain the property of the seller until the purchase price has been paid in full.

5 Disclaimer and Limitation of Liability

The seller's liability under these terms and conditions is limited as follows:

5.1 The seller is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health.

5.2 In cases of slight negligence, the seller shall be liable for breaches of a material contractual obligation. A material contractual obligation within the meaning of this clause is an obligation whose fulfillment is essential for the proper performance of the contract and on whose fulfillment the other party may therefore regularly rely.

5.3 Liability pursuant to clause 5.2 is limited to the typical and foreseeable damage at the time of conclusion of the contract.

5.4 The limitations of liability apply accordingly in favor of the employees, agents and vicarious agents of the seller.

5.5 Any liability of the seller for given guarantees and for claims based on the Product Liability Act or in the event of data protection violations remains unaffected.

6 Warranty

The statutory warranty rights for defects apply.

7 Other

7.1 The contract language is German.

7.2 Should individual provisions of this contract violate mandatory law in whole or in part, or be void or ineffective for other reasons, the remaining provisions shall remain unaffected.

7.3 The European Commission provides a platform for online dispute resolution, which the customer can access at http://www.ec.europa.eu/consumers/odr . The seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

7.4 The contractual relationship between the seller and the customer is governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer and does not have a residence in the Federal Republic of Germany, the contractual relationship is governed exclusively by the laws of the Federal Republic of Germany, excluding the CISG, unless mandatory provisions of the law of the state in which the consumer has their habitual residence provide otherwise.

7.5 If the customer does not have a general place of jurisdiction in Germany or in another EU member state, or if the customer is a merchant or a legal entity under public law, or if the customer has moved their permanent residence abroad after these terms and conditions have come into effect, or if their residence or habitual abode is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from this contract shall be the seller's place of business.
